Of our consideration:

In the publication dated July 21 entitled “The legal mechanisms of PETROPERU for not maintaining the North Peruvian Pipeline”, signed by Álvaro Meneses Gutiérrez, statements are made that are far from the reality that we have clarified.

The note states that “Petroperu's recent past shows the legal battles that the state company has entered not only to avoid maintaining damaged pipelines but has also served to refuse to give economic and health repairs to the Loreto native communities affected by oil activity and currently surviving heavy metal damage.”

"Petroperú's intention was clear: not to maintain or replace damaged pipelines, as OEFA has ordered since February 2016."

The above is not true. PETROPERU’s legal actions before the Judicial Branch exclusively question the competence of the OEFA to impose actions or sanctions on technical issues - such as maintenance - of the North Peruvian Pipeline (ONP); since it is the responsibility of another supervisory entity: the Supervisory Body for Investment in Energy and Mining (OSINERGMIN).

The contentious administrative process raised by the Company on the subject of the functional competencies of supervisory bodies has no causal relationship with the issues of maintenance to the pipeline.

In this regard, PETROPERU has provided and performs regular maintenance on the ONP. It is a public fact that between 2016 and 2017 it was given comprehensive maintenance with the highest technology available to ensure its normal operation. In addition, these tasks are permanent activities carried out by the Company and are supervised by OSINERGMIN. Therefore, it is not possible to "refuse" to carry them out, and less "avoid" doing them through dilatory legal mechanisms.

Moreover, in addition to these regular activities, the Company is investing in the next two years up to US $ 300 million in improvements to the pipeline, as part of the ongoing modernization and technological update process.

Consequently, we reiterate that the pipeline has been maintained and that it is a permanent work of the company, regardless of the result of any administrative contentious process in which it is involved.

On the other hand, it is also not true that PETROPERU refuses to give compensation or attend health emergencies to the affected populations. Both actions have taken place when there has been proven damage and the origin of these are spills generated by natural problems or eventual technical failures of the ONP; while food, water and medical attention is carried out preventively and temporarily (during the emergency). In all these circumstances, the company fully assumes responsibility and preventive care for people is as timely and effective as possible.

In parallel and permanently, PETROPERU develops social responsibility programs in the areas of health, education, capacity development and implementation of productive projects.

It should be noted that, since its creation, PETROPERU maintains a permanent commitment to the Amazon and the native communities. Not only is it one of the main contributors in the country but it also makes the oil fee viable through the service provided by the ONP with resources that reach the producing regions directly.

We are surprised that the editor of the note or a representative of Wayka has not made contact with us in order to provide him with the official position of the company and absolve any doubts that the medium may have about the particular one; It seems to us that for a minimum balance in the information it was important to consider our version. We are at your disposal for this purpose at the time you see fit.
