Main Procedures

Board Agreement No. 078-2024-PP.

1. Modification of articles 2, 7, 9, 61, as well as numeral 36 of Annex 3 - Definitions of the Regulation, in order to comply with its adaptation to the new General Law of Public Procurement - Law No. 32069.

Board Agreement No. 039-2024-PP.

1. Include the following as grounds for non-application of the Petroperú Contracting Regulations:

   bb) The contracting of the Executor of Public Investment Projects, Optimization Investments, Marginal Expansion, Rehabilitation and Replacement (IOARR), including the Emergency IOARR and Executor of operation and/or maintenance activities, services or works that requires contracting Petroperú within the framework of Law No. 29230, the Regulations; and its amendments, to meet the conditions established by a public entity regarding the technical and/or economic offer in Selection Processes under the Works for Taxes mechanism and whose contract is a mandatory document to be presented by Petroperú in the stage of perfecting the resulting agreement(s). Likewise, everything related to Central Administration and Monitoring is not applicable, in accordance with the scope indicated in the Regulation of Law No. 29230.

Board Agreement No. 075-2023-PP.

1. Modification of Article 72, sub-item 6.1. of Appendix 02, and Section V of the Contracting Regulations of Petroperú.

Board Agreement No. 120-2022-PP.

1. Include as an additional condition to those provided in literal y) of article 5 of the Regulation, that a supplier not domiciled in the country will be contracted "when provided by express mandate of Law or Supreme Decree".

Board Agreement No. 094-2022-PP.

1. Include the following as grounds for non-application of the Petroperú Procurement Regulations:
   
   "aa) To hire specialized services for the legal defense of workers, former workers; members of the Board of Directors and former members of the Board of Directors; Chairman of the Board of Directors and Former Chairman of the Board of Directors, Chairman of the Integrity Committee and Former Chairman of the Integrity Committee; whose legal actions are initiated by reason of the exercise of the functions or assignments made to the aforementioned officials of Petroperú.
   
   Likewise, to hire expert services in accounting, economic or related matters; that are required to complement the legal defense of officials or former officials of Petroperú, detailed in the previous paragraph".
2. The repeal of the provisions of article 47.n) of the Petroperú Procurement Regulations.
